Terms of Service

These Terms of Service ("Terms") govern your use of the Holy Way mobile application (the "App"), provided by Ilie Babcenco, an individual operating Holy Way as a sole developer based in the Republic of Moldova ("we", "us", "our"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The Service

Holy Way is a devotional Bible application that delivers personalized daily Scripture passages, supports verse bookmarking and highlighting, and helps users build a daily reading habit. It is offered free of charge for personal, non-commercial use.

2. Eligibility

You must be at least 13 years old to use Holy Way. By using the App, you represent that you meet this age requirement.

3. Your Account

• You are responsible for keeping your password confidential and for any activity that occurs under your account.
• Notify us immediately if you suspect unauthorized access.
• You may delete your account at any time via Settings → Delete account. Deletion is permanent and irreversible.

4. Acceptable Use

You agree not to: - Use the App for any unlawful purpose - Attempt to access another user's account - Reverse-engineer, decompile, or disassemble the App or its API - Use automated tools (bots, scrapers) to access the App - Interfere with the App's normal operation - Submit content (e.g., in the optional onboarding "additional details" field) that is hateful, harassing, defamatory, or that violates any third party's rights

We may suspend or terminate accounts that violate these rules.

5. AI-Generated Content — Important Disclaimer

The daily Scripture passages selected for you, and the accompanying reflections, are produced with the assistance of artificial intelligence ("AI Content"). You acknowledge and agree:

• AI Content is not a replacement for spiritual direction, pastoral counsel, mental health treatment, or professional advice of any kind.
• AI Content may contain errors, omissions, theological inaccuracies, or interpretations you disagree with.
• AI Content is not issued by, endorsed by, or representative of any specific church, denomination, or religious authority.
• We make no warranty that AI Content is accurate, complete, doctrinally sound, or fit for any particular purpose.
• You are solely responsible for any spiritual, theological, or life decisions you make based on the App's content. If you are in crisis or need professional support, please contact a qualified counselor, therapist, or crisis hotline.

6. Scripture Content

Bible passages displayed in the App come from publicly available translations. Each translation's copyright and licensing notice is shown within the App. You may share Scripture passages from the App for personal, devotional, and non-commercial purposes consistent with each translation's license.

7. Intellectual Property

The App's design, code, branding, and original written content (excluding Bible passages, which are governed by their respective translation licenses) are the property of Ilie Babcenco and are protected by copyright and trademark law. You may not copy, modify, distribute, or create derivative works without our written permission.

8. Privacy

Your use of the App is also governed by our Privacy Policy at https://holyway.app/privacy, which explains what data we collect and how we use it.

9. Service Availability

The App is provided "as is" and "as available". We do not guarantee uninterrupted service, error-free operation, or that defects will be corrected. We may modify, suspend, or discontinue any part of the App at any time without prior notice.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• We are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the App.
• Our total aggregate liability arising from or related to your use of the App is limited to the greater of (a) the amount you have paid us in the twelve months preceding the claim, or (b) USD $100.
• Nothing in these Terms limits liability that cannot be excluded under applicable law (including liability for death, personal injury, fraud, or willful misconduct).

11. Indemnification

You agree to defend and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the App.

12. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason — including violation of these Terms. You may stop using the App and delete your account at any time. Sections 5, 7, 10, 11, and 13 survive termination.

13. Governing Law

These Terms are governed by the laws of the Republic of Moldova, without regard to its conflict-of-laws principles. Any dispute will be brought exclusively in the courts of the Republic of Moldova, unless mandatory local consumer-protection laws give you the right to bring it elsewhere.

14. Changes to These Terms

If we make material changes, we'll notify you in-app or by email at least 14 days before the change takes effect. Continued use after the effective date constitutes acceptance.
